Terms & Conditions of Hire
1. Hire Period & Collection
1.1. The hire period is strictly for the dates specified on the invoice.
1.2. The Hirer (the customer) is responsible for arranging the collection and return of the hired items within the agreed time slots.
1.3. If items are not returned by the agreed date and time, a late return fee equivalent to the daily hire rate will be charged for each day the items are overdue.
2. Condition of Items & Inspection
2.1. All items are inspected and maintained to a high standard before collection.
2.2. It is the Hirer’s responsibility to inspect the items at the time of collection. By taking possession of the items, the Hirer agrees that they are complete, clean, and in a fit and serviceable condition.
3. Liability for Damage, Loss, or Theft
3.1. The Hirer assumes total responsibility for the care and safekeeping of all hired items from the moment they leave the Company's possession until they are safely returned and checked back in.
3.2. Full Damage Liability: In the event that any hired item is lost, stolen, destroyed, or damaged beyond repair during the hire period, the Hirer is fully liable for the full replacement value of the item (the retail cost to purchase an identical or equivalent new item).
3.3. Repairable Damage: If an item is returned damaged but repairable (e.g., severe staining, broken components, or deep gouges), the Hirer will be liable for the full professional repair or restoration costs, including any specialist cleaning fees.
3.4. The Company will assess the returned items within 48 hours of return and will notify the Hirer in writing of any damage charges. Payment for damage or replacement must be settled within 7 days of notification.
4. Setup, Use, and Safety (Dry Hire)
4.1. As a "Dry Hire" agreement, the Hirer is solely responsible for the safe transport, unloading, correct assembly, setup, and packing away of all items.
4.2. The Hirer agrees to use the items only for their intended purpose. Garden games and outdoor props must not be left outside overnight or exposed to adverse weather conditions (such as heavy rain or high winds). Any weather-related water damage or warping will be treated as damage under Section 3.
4.3. Public Liability Disclaimer: The Company accepts no liability for any injury, accident, loss, or damage to persons or third-party property arising from the transport, setup, use, or misuse of the hired items. The Hirer is responsible for ensuring adequate supervision (especially regarding children using giant garden games) and maintaining a safe environment at their venue.
5. Cancellation & Amendments
5.1. Cancellations made within 60 days of the hire date may be subject to forfeiture of the booking deposit.
